Clery Act

The Clery Act at Collin College

The Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act, 20 U.S.C. § 1092(f) (Clery Act) is a federal law which requires all colleges and universities that receive federal funding to disclose information about crimes that occur on and near their campuses. Additionally, the Clery Act requires colleges and universities to publish an Annual Security Report (ASR) informing their communities of campus safety policies and procedures, crime prevention efforts, and campus crime statistics. Colleges and universities that have on-campus student housing are also required to publish an Annual Fire Safety Report (AFSR) informing their communities of fire safety policies and procedures and fire statistics.

Collin College prepares and publishes the Annual Security and Fire Safety Report (ASFSR) by October 1 each year in order to comply with the Clery Act. Included in the ASFSR are the campus crime, arrest, and referral statistics (i.e., campus crime statistics) for the previous three (3) calendar years, which include incidents reported to the Collin College Police Department, designated campus security authorities (CSAs), and local law enforcement agencies.

A campus security authority (CSA) is a Collin College employee who has significant responsibility for student and campus activities. Collin College students and employees are encouraged to report crimes to a CSA for the purpose of making emergency notifications and timely warning reports as well as inclusion in the annual disclosure of crime statistics.

At Collin College, CSAs include the following employees:

1. All Collin College Police Department officers, sergeants, lieutenants, and the chief of police;
2. The dean of students, associate dean of Title IX compliance, associate deans of students, and student conduct officers;
3. The chief student success officer, vice president of student and enrollment services, deans of student and enrollment services, and associate deans of student and enrollment services;
4. All campus vice president/provosts;
5. All academic/workforce deans, associate deans, and program directors;
6. All evening and weekend administrators;
7. The director of student housing operations and all resident life staff;
8. All athletics directors and associate athletics directors;
9. All athletics coaches, assistant coaches, volunteer coaches, and trainers;
10. All student organization advisors; and
11. Any other employees who have a significant responsibility for student and campus activities (e.g., student travel responsible parties).

CSAs are not obligated to investigate allegations of Clery Act crimes that are reported to them, but they are required by law to report such crimes to the Collin College Police Department. When a Clery Act crime is reported to a CSA, the CSA must complete the Campus Security Authority (CSA) Crime Reporting Form online.

Campus “pastoral counselors” and “professional counselors,” when acting as such, are not considered to be a CSA, and are not required to report crimes for inclusion in the annual disclosure of campus crime statistics. However, they are encouraged, if and when they deem it appropriate, to inform persons being counseled of the procedures to report crimes on a voluntary, confidential basis for inclusion in the annual disclosure of campus crime statistics. Collin College does not currently employ any pastoral counselors. Collin College's licensed professional counselors are informed of the procedures to report crimes during various training sessions throughout each academic calendar year.

The Drug-Free Schools and Communities Act of 1989 (DFSCA) requires institutions of higher education to establish programs that address unlawful possession, use, or distribution of alcohol and illicit drugs, and foster safe and drug-free learning environments which promote academic achievement.
